Coverage & Limits.

KWORCC provides statutory Workers Compensation benefits and Employers Liability coverage with $1,000,000 limits for accidents and diseases. Excess insurance covers claims above $850,000, and aggregate excess insurance offers protection if losses exceed 125% of annual premiums. KWORCC requires independent contractors, volunteers, and community service workers to have appropriate coverage. As a self-insurance pool, KWORCC operates under bylaws shaped by its member counties.

Workers Compensation - Statutory Benefits

Employers Liability:
  • Bodily Injury By Accident - Each Accident: $1,000,000
  • Bodily Injury By Disease - Each Employee: $1,000,000
  • Bodily Injury By Disease - Policy Limit: $1,000,000 

​Comments:

  • Specific excess insurance covers claims that exceed $850,000 for each accident. In addition to the specific excess insurance coverage, KWORCC carries an aggregate excess insurance policy that provides coverage should the pool experience losses in excess of 125% of the audited premium during a policy year. There have been no assessments since the inception of the pool in 1992.
  • The bid presented is based on your County’s Experience Modification which is calculated based on loss experience and is reviewed each year by the National Council on Compensation Insurance (“NCCI”).
  • KWORCC has the following specific policies which apply to the Member Counties:
    • Independent Contractors/Subcontractors: All individuals and businesses who perform any type of service or work for the Member County (other than those who exclusively supply goods) are required to provide written proof of workers compensation coverage prior to engaging in such work or service.
    • Volunteers/Community Service: Member County is required to file a Form K-WC-123 to cover all volunteer workers and/or a K-WC-135 to cover all prisoner and/or community workers at Member County.
    • Autopsies: Member Counties are required to request the County Coroner or District Coroner to conduct an autopsy in the event an employee’s death occurs suddenly and the cause of death is not apparent.
  • Overtime remuneration: The extra pay for overtime work can be excluded from the payroll on which premium is computed if records show overtime pay separately by employee and in summary by classification.
  • Pay for vacations, sickness and holidays can be excluded from the payroll on which premium is computed if records show them separately by employee and in summary by classification.
  • KWORCC is a self-insurance pool. Membership is governed by KWORCC bylaws and applicable statutes. Bylaws are subject to amendment by two-thirds majority of KWORCC Member Counties.
